Procurement Support : helping buyers (especially NHS trusts) to make contracts for technology and outsourcing services. John's vast experience of working with suppliers gives him an invaluable insight into difficult areas such as due diligence, deal economics and pricing. John is an expert in public procurement law, with practical experience of designing and planning procurement competitions (especially competitive dialogue), as well as preparing model contracts, specifications, OJEU notices, PQQ's and evaluation criteria. Above all, he aims to minimise the cost and time involved for buyers and suppliers alike, whilst ensuring that the risk of legal challenges is minimised.
Bid Support : augmenting suppliers' in-house legal and commercial teams on complex, high value bids (especially in the public sector); typically this involves attending negotiation meetings, reviewing contracts and schedules, and flow down of terms to sub-contractors. In the last two decades, John has performed this role for CSC, Fujitsu, IBM, Capgemini, Capita and many other service providers in relation to contracts worth many hundreds of millions of pounds.
Trouble Shooting on Runaway Projects : John's background as a litigator enables him to get to the bottom of problems quickly, and to recommend practical solutions. He's helped to recover many runaway projects by re-baselining specifications and project plans, and establishing effective governance. Occasionally, projects can't be saved, and John has represented buyers and sellers at mediations, as well as providing litigation support.
Commercial Management : re-engineering commercial policy, process and standard terms of business in order to maximise the chances of winning business, reduce bid costs and minimise the risk of making bad contracts. These projects need executive sponsorship and buy in from key stakeholders in sales, delivery, finance, legal and commercial functions. Clients that have benefited are usually going through a significant change, such as establishing new services or entering new markets.
